On November 19, 2023, an incident occurred in West Oakland involving an ICE vehicle that allegedly totaled the car of a pregnant woman during a high-speed chase. The man pursued by ICE had reportedly dropped off a child at an elementary school prior to the encounter. Fortunately, the woman was unharmed. Waters’ comments on this situation sparked backlash on social media, with users labeling his remarks as racist.

In response to criticism, Waters engaged with users on SFGate’s Instagram post, questioning how his support for deportation could be seen as racist. He went on to assert, “no one is being ‘kidnapped’ how is it wrong?” and defended the agency’s actions, stating, “You don’t get to enter a country illegally then complain when you’re told to leave or detained and forced to leave!” Following these interactions, Waters’ Instagram profile and his posts were deleted.

Waters’ professional background reflects his long-standing role within the fire department. His LinkedIn profile has since been altered, now describing him as a landscape photographer, and his previous listings as a lieutenant have been removed.
